UK Temporary cap on migrant workers in place
The Government's temporary cap on migrant workers is now in place. The temporary cap has been introduced to stop a surge of applications being made before the permanent cap is introduced in April 2011.
The interim cap applies to Tier 2 General applications (new hires, extension applications), so excludes applications through the Intra-Company Transfer (ICT) route.
During the interim cap the Government will limit the number of certificates of sponsorship an employer will be able to issue in relation to sponsoring a migrant worker or extending an existing employee's visa. The allocation will be dependant on the number of certificates issued during the same period last year.
Employers who don't have a sponsorship licence or are currently in the process of applying for one will need to make a request for exceptional consideration. Each case will be considered and ranked against a set criterion.
It is now more important than ever for employers to ensure they comply with duties associated with being a sponsored licence holder and maintain their A-rating.
